In 2025, the Estonian Patent Office had the Patent Department, a Trade Mark Department, the Intellectual Property Rights Department, and the Registry Department. The Industrial Property Board of Appeal also operates under the Office.
The protection of industrial property is an inseparable part of the constitutional legal order. Industrial property is protected under § 32 of the Constitution of the Republic of Estonia, providing that the property of every person is inviolable and equally protected.
The Estonian Patent Office’s international cooperation supports the development of Estonia’s system of legal protection for intellectual property rights and helps to ensure that our services, expertise, and working practices are in line with international trends and agreements.
It is possible to apply for patent protection or utility model protection for inventions under the Patent Act and the Utility Model Act, which entered into force on 23 May 1994.
Tööstusdisainilahendustele on Eestis võimalik kaitset taotleda tööstusdisaini kaitse seaduse alusel. Tööstusdisainilahenduste registreerimisel rakendatakse avaldus- ehk registreerimissüsteemi.
In Estonia, it is possible to apply for the protection of trade marks under the Trade Marks Act that took effect on 1 May 2004. From 1 May 2004, the EU legal acts concerning trade marks are also valid in Estonia.
Geograafiline tähis kaitseb toote nime, mille omadused või maine tulenevad selle geograafilisest päritolust. Tegemist on kollektiivse õigusega, mille registreerimisel saadav kaitse on tähtajatu.
As of 1 April 2021, the Estonian Patent Office performs certain practical tasks in the field of copyright and related rights.
The Board of Appeal is an independent pre-trial body that resolves appeals against decisions of the Estonian Patent Office and disputes related to industrial property rights.

Revenue is generated from the fees collected for the Patent Office's services and is transferred to the state budget. The fee rates are established by the State Fees Act. The Patent Office's operating expenses are financed from the state budget in accordance with the State Budget Act and from earmarked funds.
